Terms and Conditions

Photo/Video Rights: Under current copyright laws, ownership of all photos belongs entirely to Elev8vid. Elev8vid retains all rights to photos taken of properties unless otherwise agreed upon in writing, and only licenses the use of the images to the Listing Agent (“CLIENT”) of the property for marketing purposes while the listing is active (up to one year). All images produced for the client may be used by the client for any and all marketing materials and campaigns associated with the property and for the client's self promotion until the license expires. The photos may also be used by the client's parent company for the sole purpose of marketing the specific property photographed. Any usage of the images by a third party, including but not limited to, architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by Elev8vid.

Relationship of the Parties: Elev8vid is an independent contractor, and shall not be deemed to be an employee of the client. No agency, partnership, joint venture, or employee--employer relationship is intended or created by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. Elev8vid and the photos or any other deliverables prepared by Elev8vid shall not be deemed a work for hire as defined under Copyright Law. All rights granted to client are contractual in nature and are expressly defined by this agreement.

Payments: Payment in full is expected at time service is provided unless otherwise specified.

Cancellations and Rescheduling: If cancellation or rescheduling is required, each party is expected to provide 24 hour notice when possible. In some cases (weather, emergency responder activity, FAA restrictions, etc.) Elev8vid may not be able to complete the shoot at the scheduled time and may be unable to give 24 hours notice. In these cases, Elev8vid will contact the client to reschedule.

Editing: We want to represent your property honestly and accurately. We will not photoshop out physical flaws in the property in any way that would not represent the property as it actually exists.

Photo/Video Delivery: We strive to have all photos and videos delivered within 24 to 48 hours. We will send an email with a link and instructions for accessing your deliverables.

Pets and People: We prefer not to include any pets or people in our images. It is the client's responsibility to ensure no pets or people are outside on the property during our shoot.
